A
new bill, SB2485, is designed to harm condominium associations and give
delinquent owners a free ride at the expense of owners who pay their
assessments on time.
SB2485is
a bill which will amend the Illinois Condominium Property Act to further hinder
condominium associations in the collection of unpaid assessments. The bill
would require associations to grant a hearing to any delinquent unit owner
before commencing any collection proceeding. This will impose an
additional burden on a Board while permitting a unit owner to remain delinquent
on his or her assessment obligations.
Associations
do not need more hearings, more disputes or more arguments - they need owners
to pay their assessments on time. This bill is another attempt to protect
the delinquent unit owner at the expense of the rule-abiding owners.
Please contact your state Senator to oppose this troublesome legislation.
SB2485
is scheduled to be heard next week on Tuesday so taking action quickly is
imperative.
Please filea witness slip in opposition to SB2485 and write
the members of the Senate Judiciary Committee and ask that they
oppose this bill. We will keep you updated on the status the bill.
